Know Your Rights as a NYC Tenant
New York City law protects renters. Learn what your landlord is required to do — and how to report problems to HPD or 311.
Heat & Hot Water
During heat season (October 1 – May 31), your landlord must keep your apartment warm: at least 68°F during the day (6 AM – 10 PM) whenever it is below 55°F outside, and at least 62°F at night (10 PM – 6 AM) no matter the outside temperature. Hot water must be at least 120°F all year. If your heat or hot water fails, report it to HPD or 311.
Repairs & Habitability
Your landlord must keep your apartment and building in safe, livable condition — fixing problems like leaks, broken locks, peeling paint, mold, pests, and failing plumbing. Ask for repairs in writing, and if they are not made, file a housing complaint with HPD or 311. HPD can inspect and issue violations; you do not need your landlord's permission to report.
Lead Paint
Buildings built before 1960 (and some built through 1978) may have lead-based paint. Under Local Law 1, landlords must inspect for and safely remove lead paint hazards in apartments where a child under 6 lives, using trained workers and safe work practices. If you suspect a lead hazard, report it to HPD or 311.
Harassment
It is illegal for a landlord to harass you to force you out. Prohibited conduct includes repeated baseless eviction cases, refusing to make repairs, threatening you, or disrupting your apartment with unnecessary construction. You can report landlord harassment to HPD or 311, and you may also have legal options through housing court.
